It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing. Terms and conditions may change at any time. All the below agreements apply to all our services.
General
Contracts and Booking Fee
50% booking fee must be put down at the time of booking. Paying the booking fee confirms the clients’ agreement of the contract and the Terms & Conditions. The remainder must be paid 2 weeks prior to the first function date, any delay in payment will result in additional interest charges at £5 per day. Contract details (i.e. timings and locations) cannot be changed after the customer has signed the contract. Any urgent changes will be at the discretion of Photo Video Guru and may result in other changes to make the new contract feasible. The Booking fee secures the time and services of the Photographer/ Videographer for the event and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the company due to cancellation.
Cancellation
The Client may cancel this contract at any time by giving written notice to Photo Video Guru but in doing so shall forfeit any monies paid. Cancellation less than 12 weeks before the first function will result in the payment in full. Events that are postponed to a later date will retain the fee if the company can re-schedule for the new date and time.
Copyright
As per UK Copyright Law Photo Video Guru holds the copyrights to all digital files/images/videos. As a company we give consent to the client to also hold the copyrights to images/ videos. Photo Video Guru may display any photographs/ videos included in this contract for advertising purposes.
Force majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Attendance
In the unlikely event of the assigned Photographer/ Videographer/ other employees being unable to attend your event due to unforeseen circumstances, we reserve the right to appoint another team member to attend your event on our behalf to undertake the service to his/her best ability.
Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
Coordination
An itinerary is required 2 weeks prior to the event providing as much detail as possible. Photo Video Guru will not be held responsible for the lack of coverage caused by the bride and groom, wedding party, guests, other service providers not being on time or interfering or restricting the Photographer’s/ Videographer’s or any other persons provided duty. Any overlapping during the event, Photo Video Guru will decide what is priority and this will be deemed correct unless stated otherwise prior to the function.
Parking
Parking will be chargeable to the customer where venues do not have any available. Photo Video Guru team will attempt to find free parking for a maximum of ten minutes, if unsuccessful the team will use the nearest NCP/ car park. Where events are taking place in Central London, searching for free parking is not feasible, therefore the team will go straight to an NCP.
Accommodation
Where accommodation is needed each member of the team shall require a separate room. Hotels need to be allocated within a 5-minute drive of the venue. Where separate rooms are not provided, we shall not be held responsible for lack of service due to inadequate rest.
Postage
All items are sent by Royal Mail Special Delivery; the client shall reimburse charges incurred by the company. Photo Video Guru accepts no responsibility for the reliability of the post where the customer has requested 1st class postage. We cannot be held responsible for loss or damage of mail, prints, albums frames and disks etc that are sent through the post.
Provision requirements
Food and beverages must be provided to all employees provided by Photo Video Guru. The team are entitled to a 30-minute break for any function six hours or more.
Photography
Images
All image sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to digitally capture the exact colour as seen by the human eye. Clients should be aware that colour dyes in photography may fade or discolour over a period of time due to inherent quality of dyes and insufficient care and preservation of prints and albums. Photo Video Guru may take no responsibility for the slight colour change from proofing to final completed images. Under no circumstances can we guarantee that the colour of the proofs supplied and the colour of the final images will be exactly the same. The photographer cannot guarantee any specific image nor incorporate any specific background or group arrangement.
Blinking
Should the photographer notice that a member of the event party or guest has been seen to blink, the photograph will be taken again but it is impossible to guarantee to see all of them.
Artistic Licence
The Photographer/s shall be granted artistic licence, by the client, in relation to the poses photographed and the locations used. The Photographers judgment regarding the locations/poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
Image Enhancement
Image enhancement is only available for Albums. Colour correction (i.e. sharpness, brightness) will be applied to all the chosen images. Image effects (i.e. black and white or sepia) are available within reason. Manipulations such as airbrushing and imperfection correcting will be chargeable if corrections are possible.
Final Alterations
Once artwork has been completed a proof will be available for viewing, at this point new photos cannot be added. The first draft will allow for image swapping, removing images or image colour change; any changes after this will be chargeable. Excessive changes will also be chargeable. The photographer will not be held responsible for customer disappointment of agreed album and images as long as they are technically acceptable and will face no liability. Due to the extensive process required for creating the perfect product, certain albums may require in the region of 16 weeks for completion from when the team receive the photos from the customer. To fulfil the completion times, any photos being provided by the customer must be done so within 2 weeks from the request date. If additional time is required, then this must be requested in writing.
Videography
Images
The Videographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film the exact colour as seen by the human eye.
Final Alterations
Video proofing is not available, the editing team shall use their extensive experience to complete the final product. Whilst we make full attempt to include all the parts of the ceremony into the video, due to time/ space restrictions this is not always possible and we can provide a raw version at a charge of £40. The customer is required to provide all songs they wish in the final video; the company does not take liability to any copyright infringement of songs provided. Due to the extensive process required for creating the perfect product, videos may require in the region of 16 weeks for completion from when the team receive the songs from the customer. To fulfil the completion times, any songs being provided by the customer must be done so within 2 weeks from the request date. If not provided, then a standard protocol will be followed. If additional time is required, then this must be requested in writing.
